(1) If, in any
criminal proceedings, the court is satisfied beyond reasonable doubt that a
particular organisation was, at a particular time, a criminal organisation
within the meaning of paragraph (a) of the definition of "criminal
organisation in section 83GA(1), the court may, on the application of the
Director of Public Prosecutions, make a declaration to that effect.
(2) If a declaration
is made in relation to an organisation under subsection (1), then that
organisation will, for the purposes of any subsequent criminal proceedings, be
taken to be a criminal organisation (within the meaning of
paragraph (a) of the definition of "criminal organisation" in
section 83GA(1)) in the absence of proof to the contrary.
