41—Commissioner may maintain DNA database system
(1) The Commissioner
of Police may maintain a DNA database system.
(a)
enter into an arrangement with the Minister responsible for the administration
of a corresponding law, providing for the exchange of information recorded in
the DNA database system kept under this section and a database kept under the
corresponding law; and
(b)
enter into an arrangement with the Minister responsible for the administration
of a corresponding law of the Commonwealth or with the ACC, providing for the
transmission of information recorded in the DNA database system kept under
this section to the ACC for the purpose of that authority doing any, or all,
of the following:
(i)
causing the information so transmitted to form part of a
national database;
(ii)
comparing the information so transmitted with other
information on a national database;
(iii)
identifying any matches between the information so
transmitted and other information on a national database;
(iv)
transmitting information arising from such matches to the
Commissioner of Police;
(v)
any other thing required or authorised to be done under
the corresponding law or otherwise authorised by law.
(3) In this
section—
"ACC" means the Australian Crime Commission established under the
Australian Crime Commission Act 2002 of the Commonwealth.
