(1) A person who
deposits rubbish on land without the consent of the owner or occupier or other
lawful authority is guilty of an offence.
Maximum penalty: $750.
(2) The court by which
a person is found guilty of an offence against subsection (1) may,
whether or not a fine is imposed, order the person to remove, within the time
specified by the court, the rubbish from the land on which it was deposited.
(3) If a person makes
default in complying with an order under subsection (2)—
(a) the
person is guilty of an offence and liable to a maximum penalty of $125; and
(b) the
court may order the person to pay to the owner or occupier of the land the
cost of removing the rubbish.
(4) In this
section—
"land" includes roads, streets and other public places, as well as private
land;
"rubbish" includes soil, stone, rubble, animal or vegetable matter and other
debris, waste or refuse.
