163—Disclosing existence or nature of notice
(1) A person
who—
(a) is
given a notice under section 160 that specifies that information about
the notice must not be disclosed; and
(b)
either—
(i)
discloses the existence or nature of the order to another
person; or
(ii)
discloses information to another person from which the
other person could infer the existence or nature of the order,
is guilty of an offence.
Maximum penalty: $10 000 or imprisonment for 2 years.
(2)
Subsection (1) does not apply if the disclosure is made—
(a) to
an employee, agent or other person in order to obtain a document that is
required by the order in order to comply with it, and that other person is
directed not to inform the person to whom the document relates about the
matter; or
(b) to
obtain legal advice or legal representation in relation to the order; or
(c) for
the purposes of, or in the course of, legal proceedings.
