21—Amendment of section 55—Licences, authorities and permits
(1) Section
55(4)—after "Act," insert:
suspend or
(2) Section 55(5), (6)
and (7)—delete subsections (5), (6) and (7) and substitute:
(5) A person whose
licence, authority or permit is suspended or revoked under subsection (4)(c)
may appeal to the Administrative and Disciplinary Division of the District
Court against the suspension or revocation.
(6) Subject to
subsection (8), an appeal must be instituted within 1 month of the
suspension or revocation.
(7) The Minister must,
if required by the appellant, state in writing the reasons for the suspension
or revocation.
(8) If the reasons of
the Minister are not given to the appellant, in writing, at the time of making
the decision to suspend or revoke and the appellant (within 1 month of the
making of the decision) requires the Minister to state the reasons in writing,
the time for instituting the appeal runs from the time at which the appellant
receives the written statement of those reasons.
