(1)  In this section –

child has the same meaning as in section 124A ;

person in a position of authority has the same meaning as in section 124A .

(2)  Any person who is 18 years of age or older is guilty of a crime if that person is in a position of authority in relation to a child and that person unlawfully and indecently assaults that child.

Charge:  Indecent assault of child [ or young person] by a person in a position of authority.

(3)  Consent to an indecent assault is not a defence to a charge under this section other than in circumstances where the age difference between the accused and the complainant is not more than 2 years.
