CRIMINAL CODE 1924 - SECT 296
Frauds on creditors
(1) If any person
(a) in incurring any debt or liability has, with intent to defraud, obtained
credit by a false pretence or by means of any other fraud;
(b) with intent to defraud his creditors or any of them, has made or caused to
be made any gift or transfer of, or charge on, his property; or
(c) with intent to defraud his creditors or any of them, has concealed or
removed any part of his property since, or within 2 months before, the date of
any unsatisfied judgment or order for payment of money obtained against him
he shall be guilty of a crime. Charge: Fraud on a creditor.
(2) For the purposes of this section a person who obtains a judgment
against any such person shall be deemed to have been a creditor at the date on
which any such act as aforesaid is alleged to have been done, if the suit or
action in which such judgment is obtained had been instituted at that date.
