A person charged with a crime under the provisions of section 63 shall not be acquitted of such crime on the ground that the evidence discloses that he is guilty of a crime under the provisions of section 56 or of section 58 , but no person acquitted or convicted of such crime shall be afterwards prosecuted upon the same facts under either of the last-mentioned sections.
