(1) A person may apply to the Supreme Court for an order to be made under subsection (2) that restrained property, or forfeited property, be destroyed, if the person (a) has responsibility for the control or management of the restrained property; or(b) has responsibility for the control or management of the forfeited property for and on behalf of the State.(2) On hearing an application under subsection (1) , the Supreme Court may order that the property be destroyed if satisfied that it would not be in the public interest to preserve the property.
