(1)  A person who intends to make an application under section 410 of the Code is to give written notice of that intention to the Director of Tasmania Legal Aid.

(2)  An application –

(a) may be made to the court or to a judge in chambers; and

(b) is to be supported by an affidavit as to the appellant's circumstances.
