WESTERN AUSTRALIA LEGISLATIVE ASSEMBLY (Introduced by Mr McGinty) CRIMINAL INJURIES COMPENSATION AMENDMENT BILL 1997 A BILL FOR AN ACT to amend the Criminal Injuries Compensation Act 1985. The Parliament of Western Australia enacts as follows: Short title 1. This Act may be cited as the Criminal Injuries Compensation Amendment Act 1997. 5 Commencement 2. This Act shall come into operation on the day on which it receives the Royal Assent. No. 97 -- 1 Criminal Injuries Compensation cl. 3 Amendment Act 1997 Principal Act 3. In this Act the Criminal Injuries Compensation Act 1985* is referred to as the principal Act. [* Reprinted as at 12 February 1997.] 5 Section 20 amended 4. Section 20 of the principal Act is amended -- (a) in subsection (1) by deleting ''$15 000, or such other'' and substituting the following -- '' $75 000, or such greater ''; 10 (b) by inserting at the end of subsection (2) the following -- '' unless the offences or alleged offences were against two or more persons 15 ''; and (c) by inserting after subsection (3) the following -- '' (4) Notwithstanding any other provision of this section, where an 20 application is made under this Act for compensation for injury or loss suffered by 2 or more persons in consequence of the commission of an offence or alleged offence or 2 or more offences or alleged offences 25 against those persons the Chief Assessor may, in determining that application, award more than the prescribed maximum amount referred to in subsection (1) in the aggregate in respect of an offence or alleged 2 Criminal Injuries Compensation Amendment Act 1997 cl. 4 offence or all of the offences or alleged offences. (5) The provisions of subsection (4) shall apply to any application determined 5 after 1 July 1997 and the Chief Assessor shall, on the written request of the applicant, make a fresh determination in relation to any application determined between 1 July 1997 and the 10 commencement of the Criminal Injuries Compensation Amendment Act 1997. ''.
