For the purposes of
this Act, a charge is finalised without a finding of guilt if —
(a) the
charge is withdrawn; or
(b) the
charge is dismissed without a finding as to whether the person charged is
guilty or not guilty; or
(c) the
person charged is found not guilty of the charge and is not found guilty of
any other offence of which the person could have been found guilty as a result
of the charge and —
(i)
no appeal is commenced against the finding; or
(ii)
an appeal is commenced against the finding and the appeal
is withdrawn or the finding is confirmed.
