(1) This section
applies to and in respect of a suspect if an identifying procedure may be done
on the suspect under section 40(1).
(2) An adult suspect
who has consented to undergoing the identifying procedure may withdraw his or
her consent at any time before the procedure has been completed.
(3) A responsible
person who has consented to an identifying procedure being done on a suspect
who is a protected person may withdraw his or her consent at any time before
the procedure on the suspect has been completed.
(4) If consent is
withdrawn under this section, section 40(2) or (3) applies, as the case
requires.
