(1) In this section
—
suspect means a suspect who is an adult.
(2) An application for
an approval under this section to do a non-intimate identifying procedure on a
suspect must be made to another officer who is a senior officer and not
involved in the investigation of the offence to which the proposed
non-intimate identifying procedure relates.
(3) The application
may be made by remote communication.
(4) The application
must —
(a) if
practicable be in writing;
(b) name
the suspect to whom it relates;
(c)
state the offence that the suspect is suspected of having committed;
(d)
specify the identifying particular that is sought and the non-intimate
identifying procedure by means of which it is to be obtained;
(e)
state the grounds on which the applicant suspects —
(i)
that the suspect has committed the offence; and
(ii)
that the identifying particular sought will afford
evidence of whether or not the suspect committed the offence.
