(1) For the purposes
of making an unexplained wealth declaration or a criminal benefits
declaration, the court may receive evidence of the opinion of a person of a
kind listed in subsection (2) who is experienced in the investigation of
illegal activities involving prohibited plants or prohibited drugs, about the
following matters —
(a) the
amount that was the market value at a particular time of a particular kind of
prohibited plant or prohibited drug;
(b) the
amount, or range of amounts, ordinarily paid at a particular time for doing
anything in relation to a particular kind of prohibited plant or prohibited
drug.
(2) For the purposes
of subsection (1), the following persons are listed —
(a) a
police officer of Western Australia;
(b) a
member of the Australian Federal Police;
(c) an
officer of Customs within the meaning of the Customs Act 1901 of the
Commonwealth;
(d) the
DPP.
(3) Subsections (1)
and (2) have effect despite any other enactment, or any practice, relating to
hearsay evidence.
