A finding that
particular property is crime-used or crime-derived, or that there are
reasonable grounds for suspecting that it is crime-used or crime-derived, and
any decision, declaration or order based on such a finding —
(a) need
not be based on a finding as to the commission of a particular confiscation
offence, but may be based on a finding that some confiscation offence or other
has been committed; and
(b) may
be made whether or not anyone has been charged with or convicted of the
relevant confiscation offence; and
(c) may
be made whether or not anyone who owns or effectively controls the property
has been identified.
