DANGEROUS GOODS (ROAD TRANSPORT) REGULATION 2010 (NO 12 OF 2010) - REG 157

Offences—emergency plans

    (1)     A prime contractor commits an offence if the prime contractor—

        (a)     transports a placard load; and

        (b)     does not have an emergency plan for the transport of the load.

Maximum penalty: 40 penalty units.

    (2)     A person commits an offence if the person—

        (a)     consigns a placard load for transport; and

        (b)     does not have an emergency plan for the transport of the load.

Maximum penalty: 40 penalty units.

    (3)     An offence against this section is a strict liability offence.

    (4)     In this section:

"emergency plan", for the transport of a placard load, means a written plan, for dealing with any dangerous situation arising from the transport of the goods, that is prepared having regard to any guidelines approved by the Australian Transport Council.
