DANGEROUS SUBSTANCES (EXPLOSIVES) REGULATIONS 2004 (NO 10 OF 2004) - REG 245

    (1)     If the treatment of a misfire has involved the firing of a charge, the person controlling or managing the blasting site must ensure that work does not restart on the blasting site until—

        (a)     the shotfirer has searched thoroughly for any unexploded explosive; and

        (b)     any explosive discovered has been safely disposed of; and

        (c)     the shotfirer is satisfied that it is safe to resume.

Maximum penalty: 30 penalty units.

    (2)     An offence against this regulation is a strict liability offence.
