(1) This regulation applies if the person controlling or managing the blasting site (the controller or manager ) considers that the misfire cannot be dealt with in accordance with this division.
(2) The controller or manager must—
(a) immediately take steps to ensure that instructions to deal safely with the misfire are issued; and
(b) ensure that the instructions are carried out; and
(c) make an accurate written record of the instructions; and
(d) if the misfire is in a mine or quarry—tell an inspector in writing about the misfire as soon as possible after the misfire.
Maximum penalty: 20 penalty units.
(3) The controller or manager must keep the record made for subregulation (2) (c) for at least 5 years after the misfire.
Maximum penalty: 20 penalty units.
(4) An offence against this regulation is a strict liability offence.
