DANGEROUS SUBSTANCES (EXPLOSIVES) REGULATIONS 2004 (NO 10 OF 2004) - REG 289

Consumer fireworks—place of storage

    (1)     A person must store a consumer firework under the licence

        (a)     away from windows; and

        (b)     away from any source of ignition; and

        (c)     away from any area accessible by the public; and

        (d)     in a cabinet or room that is kept locked at all times except when necessary to take in or remove consumer fireworks.

Maximum penalty: 10 penalty units.

    (2)     This regulation does not apply if the consumer firework is stored in a display cabinet that complies with regulation 276 (2) (Display of consumer fireworks for supply).

    (3)     An offence against this regulation is a strict liability offence.
