GENE TECHNOLOGY REGULATIONS 2004 (NO 17 OF 2004) - NOTES

- made under the Gene Technology Act 2003

Dictionary

(see reg 3)

Note 1     The Legislation Act contains definitions and other provisions relevant to these regulations.

Note 2     For example, the Legislation Act, dict, pt 1, defines the following terms:

              •     for

              •     function

              •     in relation to

              •     person

              •     under.

Note 3     Terms used in these regulations have the same meaning that they have in the Gene Technology Act 2003 (see Legislation Act, s 148). For example, the following terms are defined in the Gene Technology Act 2003, dict:

              •     Commonwealth Act

              •     deal with

              •     exempt dealing

              •     gene technology

              •     genetically modified organism

              •     GMO

              •     GM product

              •     institutional biosafety committee

              •     notifiable low risk dealing

              •     Ministerial council

              •     regulator.

"advantage", in relation to an adult animal that is genetically modified, for schedule 2 (Dealings exempt from licensing)—see schedule 2, part 2.3.

"animal" includes every kind of organism in the animal kingdom, including non-vertebrates but not including human beings.

"characterised", in relation to DNA—

        (a)     for schedule 2 (Dealings exempt from licensing)—see schedule 2, part 2.3; and

        (b)     for schedule 3 (Dealings that are notifiable low risk dealings)—see schedule 3, part 3.1, clause 1.2.

"code for", in relation to a toxin, for schedule 2 (Dealings exempt from licensing)—see schedule 2, part 2.3.

"Commonwealth regulations "means the Gene Technology Regulations 2001 (Cwlth).

division 5.3 application, for schedule 4, part 4.1 (Dealings not involving intentional release of GMO into environment—Act, div 5.3)—see schedule 4, part 4.1, clause 1.1.

division 5.4 application, for schedule 4, part 4.2 (Dealings involving intentional release of GMO into environment—Act, div 5.4)—see schedule 4, part 4.2, clause 2.1.

"expert advisor " means—

        (a)     for part 4 (Gene technology technical advisory committee)—an expert adviser appointed under the Commonwealth Act, section 102 (1); and

        (b)     for part 6 (Gene technology ethics committee)—an expert adviser appointed under the Commonwealth Act, section 113 (1).

"gene-knockout mice", for schedule 3, part 3.1 (Dealings that are notifiable low risk dealings)—see schedule 2, part 2.1, item 1.

"genetic manipulation advisory committee" means the Genetic Manipulation Advisory Committee administered by the Commonwealth Minister for Health and Ageing.

"inclusion-negative", in relation to a recombinant of insect cell cultures, for schedule 2 (Dealings exempt from licensing)—see schedule 2, part 2.3.

"physical containment level", followed by a numeral, is a specified containment level under guidelines made by the regulator under the Act, section 90 for the certification of facilities.

"recombinant", in relation to matter that is a sequence or an organism, for schedule 2 (Dealings exempt from licensing)—see schedule 2, part 2.3.

"shotgun cloning", in relation to mammalian DNA, for schedule 2 (Dealings exempt from licensing)—see schedule 2, part 2.3.
