PUBLIC HEALTH (COMMUNITY PHARMACY OWNERSHIP) AMENDMENT REGULATION 2012 (NO 1) (NO 30 OF 2012) - REG 4

New section 62

in division 5.6, insert

62     Ownership of pharmacy business

    (1)     A person must not own a pharmacy business unless the person is—

        (a)     a pharmacist; or

        (b)     a complying pharmacy corporation.

Maximum penalty: 10 penalty units.

    (2)     In this section:

"community pharmacy"—see the Medicines, Poisons and Therapeutic Goods Act 2008 , dictionary.

"complying pharmacy corporation"—see the Health Act 1993 , section 128A (Complying pharmacy corporation).

"medicine"—see the Medicines, Poisons and Therapeutic Goods Act 2008 , section 11.

"own", for a pharmacy business

        (a)     includes having a legal or beneficial interest in the pharmacy business; but

        (b)     does not include having an interest in the pharmacy business only because of being the public trustee or the personal legal representative of a deceased pharmacist.

"pharmacy business" means a business providing pharmacy services at a community pharmacy.

"pharmacy services" includes—

        (a)     the supply, compounding or dispensing of a medicine; and

        (b)     advice and counselling on the effective use of a medicine.
