It is a defence to the prosecution of a driver for an offence against a provision of this division if—

    (1)     In this section:

"stopping or parking provision of this chapter" means a provision of the following divisions:

        (a)     division 2.3.5 (Metered parking);

        (b)     division 2.3.6 (Ticket parking);

        (c)     division 2.3.7 (Other ACT road rules about stopping and parking).

    (2)     A stopping or parking provision of this chapter does not apply to a driver if—
