ROAD TRANSPORT (SAFETY AND TRAFFIC MANAGEMENT) REGULATIONS 2000 (2000 NO 10) - REG 36

General defence of accident or reasonable effort (NSW cl 35)

    Without limiting any defence under Chapter 2 of the Criminal Code , it is a defence to an offence against the Australian Road Rules if the defendant proves that the offence—

        (a)     was the result of an accident; or

        (b)     could not have been avoided by any reasonable efforts by the defendant.

Note     The Australian Road Rules are not completely self-contained and need to be read with associated laws of each jurisdiction. This Part sets out some of the associated laws that are particular to the ACT. Provisions of Acts and other regulations included in the road transport legislation contain other provisions that are particular to the ACT.
