ROAD TRANSPORT (SAFETY AND TRAFFIC MANAGEMENT) REGULATION 2017 (NO 45 OF 2017) - REG 53

No offence if reasonable necessity etc

An offence against section 48, section 49, section 50, section 51 or section 52 does not apply to a person if—

        (a)     either of the following applies:

              (i)     it was reasonably necessary to park the vehicle on the land to avoid contravening the Act or another territory law;

              (ii)     the vehicle was parked on the land to deliver or collect goods or passengers, or to provide services; and

        (b)     the vehicle was on the land no longer than was reasonable.

Note     The defendant has an evidential burden in relation to the matters mentioned in this section (see Criminal Code

, s 58).
