(1) The driver of a motor vehicle (the towing vehicle ) must not tow another vehicle (the towed vehicle ) on a road if the laden weight of the towed vehicle is more than—
(a) the capacity of the towing attachment fitted to the towing vehicle; or
(b) the maximum laden weight for the towed vehicle.
Maximum penalty: 20 penalty units.
(2) Subsection (1) does not apply to the driver if the towing vehicle has a GVM over 4.5t.
(3) The road transport authority may exempt a vehicle or person from subsection (1).
(4) In this section:
"maximum laden weight", for the towed vehicle, means—
(a) the maximum laden weight for a towed vehicle specified by the manufacturer of the towing vehicle in relation to the towing vehicle; or
(b) if there is no such specification by the manufacturer, the manufacturer of the vehicle cannot be identified or the specification is not appropriate because the towing vehicle has been modified—
(i) 1.5 times the unladen weight of the towing vehicle if the towed vehicle is fitted with a braking system that is working properly; or
(ii) the unladen weight of the towing vehicle in any other case.
"towing attachment "means a device fitted to a vehicle to which the drawbar of a trailer may be attached.
