SECOND-HAND DEALERS REGULATIONS 2002 (2002 NO 8) - REG 13

    (1)     This regulation applies to a licensed second-hand dealer who was licensed as a second-hand dealer under the unamended Act immediately before the commencement of these regulations (a continuing dealer ).

    (2)     Regulations 8, 9, 10 and 11 (1) do not apply to a continuing dealer until 1 July 2002 if the dealer makes records of second-hand goods in accordance with the unamended Act, schedules 3 and 4.

    (3)     For subregulation (2)—

        (a)     a reference in schedule 3 to old wares is a reference to second-hand goods; and

        (b)     a reference in schedule 4 to old wares is a reference to second-hand goods worth more than $50.

    (4)     In this regulation:

"old wares" means old wares as defined in the unamended Act, section 2 (Definitions for Act) immediately before 14 March 2002.

"unamended Act" means the Second-hand Dealers and Collectors Act 1906 as in force immediately before 14 March 2002.

    (5)     This regulation expires on 1 July 2002.
