TREE PROTECTION REGULATION 2006 (NO 16 OF 2006) - REG 3

Transitional provision—Act, s 121 (1)

    (1)     This section applies if, before the commencement of the new Act

        (a)     an application was made to the AAT for review of a decision of the conservator under the old Act; and

        (b)     the application had not been finally decided.

    (2)     To remove any doubt, the criteria determined under the old Act, section 12 (Criteria for approval) continue to apply for the purposes of deciding the application.

    (3)     To remove any doubt, this section is additional to, and does not limit, the Legislation Act, section 84 (Saving of operation of repealed and amended laws).

    (4)     In this section:

"new Act" means the Tree Protection Act 2005 .

"old Act" means the Tree Protection (Interim Scheme) Act 2001   (repealed).
