Australian Capital Territory Numbered Regulations Australian Capital Territory Numbered Regulations(1) A person in control of the design, manufacture, import or supply of plant that may emit an unsafe level of noise must ensure that the plant is designed and constructed so that the noise emitted by the plant is as low as reasonably practicable, when installed and used in a reasonable way.
(2) A person in control of the manufacture, import or supply of plant commits an offence if—
(a) plant that may emit an unsafe level of noise is supplied to a person; and
(b) the person in control of the manufacture, import or supply of the plant fails to provide the person to whom the plant is supplied with information about—
(i) the noise emitted by the plant; and
(ii) ways to keep the noise to the lowest level that is reasonably practicable to achieve.
Maximum penalty: 20 penalty units.
(3) An offence against this section is a strict liability offence.
(4) In this section:
"unsafe level of noise" means—
(a) an A-weighted sound pressure level of 70dB (A); or
(b) an L C,peak of 130dB (C).
