Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) Subject to subsection (2), the Minister may, in his or her discretion, upon application being made in accordance with the appropriate form by the holder of a licence granted under section 19 not earlier than 2 months before or later than 3 months after the expiration of the period for which the licence was granted, renewed or last renewed, as the case requires, renew the licence with effect from the expiration of the last - mentioned period.
(2) Where:
(a) a fee is payable under this Act in respect of the renewal under subsection (1) of a licence granted under section 19; or
(b) levy is payable under the Fisheries Levy Act 1984 on the renewal under subsection (1) of this section of a licence granted under subsection 19(2), (3) or (4A);
the Minister shall not renew the licence unless the holder of the licence tenders the amount of the fee or levy, as the case may be.
