ROAD TRANSPORT (SAFETY AND TRAFFIC MANAGEMENT) REGULATION 2017 (NO 45 OF 2017) - REG 51

Parking certain vehicles on land adjoining residential land prohibited

    (1)     This section applies to—

        (a)     a vehicle or combination, whether loaded or unloaded, that is longer than 7.5m; and

        (b)     a vehicle, whether loaded or unloaded, with a GVM over 4.5t.

    (2)     A person must not park a vehicle or combination to which this section applies on land adjoining residential land for more than 1 hour.

Maximum penalty: 20 penalty units.

    (3)     An offence against this section is a strict liability offence.

    (4)     Subsection (2) does not apply to the vehicle or combination if the land where it is parked is residential land or land leased for commercial purposes.

Note     The defendant has an evidential burden in relation to the matters mentioned in s (4) (see Criminal Code

, s 58).

    (5)     In this section:

"land adjoining residential land" includes land that would, apart from an intervening road, adjoin that land.

"road" does not include a road related area.
