(1) For the purposes of subsection 34(4), the Secretary or the Chief Executive Medicare may disclose protected information to an agency if:
(a) the Secretary or the Chief Executive Medicare believes on reasonable grounds that the disclosure is reasonably necessary for:
(i) the enforcement of the criminal law; or
(ii) the enforcement of a law imposing a pecuniary penalty; or
(iii) the protection of the public revenue; and
(b) the functions of the agency include that enforcement or protection; and
(c) the disclosure is for the purposes of that enforcement or protection.
(2) In this section:
"agency" includes:
(a) a police force of a State or Territory; or
(b) any other authority or person responsible for the enforcement of the laws of the State or Territory.
