Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The Registrar may, in writing, delegate all or any of the Registrar's functions or powers to:
(a) an SES employee, or acting SES employee, in any Department of State of the Commonwealth; or
(b) an APS employee who holds or performs the duties of an Executive Level 2 position, or an equivalent or higher position, in any Department of State of the Commonwealth; or
(c) a person prescribed by the regulations.
Note: Sections 34AA to 34A of the Acts Interpretation Act 1901 contain provisions relating to delegations.
(2) In performing a delegated function or exercising a delegated power, the delegate must comply with any written directions of the Registrar.
(3) Subsection (1) does not apply to a power to make, vary or revoke a legislative instrument.
